During this sixty minute webinar, Christopher Heather KC of Tanfield Chambers and Ian Quayle of IQ Legal Training Ltd will examine how residential conveyancers should deal with restrictive covenants as part of the conveyancing process.

This training is suitable for residential conveyancers of all levels of experience and will examine:  

  • What advice should residential conveyancers give clients concerning restrictive covenants – that the property is subject to restrictive covenants but that enforceability has not been verified, or where covenants impact on client objective that enforceability has been verified?
  •  Where a restrictive covenant does or could impact the client’s objective, what investigations should be undertaken?
  •  What can transactional property lawyers learn from case law?
  •  Should transactional property lawyers ensure clients are aware that restrictive covenants are not set in stone – Section 84 LPA applications and losing the right to enforce due to delay, waiver estoppel etc?
