Restrictive Covenants – Applications to the Upper Tribunal Under s.84 of the 1925 Act

When a restrictive covenant is holding up development, the pressure to rush into an application to ‘clear the title’ can be extreme. However, many applications to the Upper Tribunal under section 84 of the Law of Property Act 1925 fail for lack of preparation and forethought. This talk with Katie Gray of Tanfield Chambers, will address how practitioners can best prepare an application for success.

Delegates will learn the following:

  • The grounds for seeking the modification and discharge of a restrictive covenant in the Upper Tribunal
  • Choosing your grounds
  • Practical ways to give your application the best prospects from the outset
  • Costs considerations
