Restrictive Covenants and Conveyancing

As the law relating to planning permission becomes more and more relaxed the creation and enforcement of restrictive covenants becomes proportionately more important.

 

This webinar which Ian has delivered in previous years on behalf of the largest legal training provider is now being offered by IQ Legal Training Limited having been completely revised and now incorporating recent case law and developments in the law.

 

Having been fortunate enough to work alongside solicitors and counsel for litigants in recent significant cases has allowed Ian an invaluable insight into the courts are dealing with old and new problems generated by the cases.

 

The course will explore:

 

  • Creating restrictive covenants concentrating on restrictions on development and the protection of overage
  • Protecting restrictive covenants – the use of agreed and unilateral notices
  • Variation, modification and removal of covenants – applications under Section 84 of the Law of Property Act 1925

 

A detailed study of relevant recent case law including 89 Holland Park Management Ltd v  Sophie Louise Hicks, Alexander Devine Children’s Cancer Trust v Housing Solutions [2020] UKSC 45 , and Bath Rugby Ltd v Greenwood.

 

Extensive notes are provided, time is allocated for questions and the course will be recorded.
