Residential Leasehold Update: Dealing with Defective Leases

IQ Legal Training has developed this new webinar to address the recent changes by the Competition and Markets Authority (the CMA) in respect of defective leases and ground rent, to help individuals navigate the new regulations.

On 19th March 2021 the CMA announced a requirement to Countryside and Taylor Wimpey to remove ground rent review provisions that compel leaseholders to pay double the existing ground rent every 10 or 15 years of the term. The CMA is still considering the position of Barratt Developments and Persimmon Homes to determine whether similar action is required.

This webinar will examine key issues when dealing with defective residential leases generally and onerous ground rent provisions in particular.

We will consider:

  • The impact of the CMA findings
  • The practicalities of varying residential leases
  • Dealing with difficult landlords – Section 35 and Section 37 Landlord and Tenant Act 1987 applications to the Lower Tribunal
  • Other solutions to defective leases
