Joint webinar with Maitland Chambers

Tim Calland of Maitland Chambers and Ian Quayle, IQ Legal Training, present a review of the recent decision of Bank of New York Mellon (International Limited) and Cine UK Limited [2021] EWHC 1013.

 

The webinar will review the judgement handed down on the 22.4.2021 and will consider the critical issues revolving round the requirement for tenants to continue to pay rent arising from commercial leases notwithstanding the closure of the tenants business or an inability to trade.

 

The webinar will explore the arguments used by tenants and defendants to contend rent should not or should be paid.

 

It will also explore the judgement of Master Dagnall in which he usefully examined recent case law, the use of relevant insurance policies, the Code of Practice for Commercial Leases 19th June 2020 and the Ministry of Housing, Communities and Local Government Statement of the 9th December 2020, and of course the construction of relevant lease terms.

 

Although the judgment concerns an application for summary judgment the decision has wide implications for anyone currently advising on commercial leases and the issue of the payment of rent.
