Climate Change and Regulation: The New Practice Note – Online Course

With the long-awaited Law Society Guidance on Climate Change now released, IQ Legal Training is excited to offer this 60-minute online course, presented by our CEO Ian Quayle, alongside Dr. Henry Crosby of Martello.

During the session, Ian Quayle will provide some practical tips for incorporating this guidance into best practice and will consider:

  • The duties of the residential conveyancer when advising clients on how climate change may affect their properties?
  • Whether and where appropriate, to what extent do residential conveyancers need to be experts on the physical effects of climate change?
  • What does a residential conveyancer need to do to avoid being negligent?
  • How the retainer and report on title should be worded to ensure compliance with the guidance.

Whilst Dr. Henry Crosby will focus on the increasing need for conveyancers and commercial real estate lawyers to integrate climate change considerations into their practice. It highlights the evolving regulatory landscape, including guidance from The Law Society and anticipated changes that will shape legal obligations. The discussion addresses key climate risks—such as flooding, ground stability, and coastal erosion—and their impact on both residential and commercial properties. By emphasising practical, actionable steps, the presentation aims to equip property lawyers with the knowledge and tools needed to navigate these emerging challenges, safeguard client interests, and meet compliance requirements effectively.

Delegates will learn the following:

  • The evolving regulatory requirements surrounding climate change and their implications for conveyancers and commercial real estate lawyers.
  • Key updates from The Law Society, including recent guidance and anticipated regulatory changes impacting legal practices.
  • Essential knowledge of climate change risks, such as flooding, ground stability, coastal erosion, and heat stress, and their effects on both residential and commercial properties.
  • Practical advice on managing climate-related risks in property transactions, including insurance considerations and compliance for clients.
  • How to use Representative Concentration Pathways (RCPs) to understand and communicate climate projections.
  • The value of comprehensive environmental reports in identifying and mitigating risks during property due diligence.
  • Strategies for advising clients on climate-related concerns while maintaining a practical and informed approach.

Extensive notes will be provided and time allocated for delegate questions.
