The right of peaceful protest is a hallowed part of the unwritten British constitution which allows (among other things)  those who wish to attract the attention of those in government to a particular point of view.  However, the recent blockages of the M25 raise concerns as to whether limits should be imposed and, if so, what legal net mechanisms need to be engaged.

The course will involve a brief overview of the rights of peaceful protest and freedom of speech.  It will then cover relevant legal constraints including at common law and in the Highways Act 1980.

Delegates will learn the following:

  • Why the right of peaceful protest is enshrined in highway law
  • The legal limits of the right of protest
  • Legal remedies available to highway authorities including prosecutions and injunctions.
